The Republic of Moldova is a location that is yet to be discovered as a business destination and an option that suits the needs of entrepreneurs. But it has plenty of advantages concerning company establishment and management, some of them being: low taxes compared to the rest of the countries in Europe, developed banking system, working flexibility of state institutions, online accounting reporting, and the use of electronic signatures.

Continued economic stabilization, the advancement of key economic reforms, and the creation of a rule based environment for businesses are the country’s key goals.

  • Employment contract

There are the following employment contract options:

  • Employment contract for an indefinite period

The individual labor contract is concluded, as a rule, on an indefinite term.

  • Employment contract for a definite period

The individual labor contract for a definite period has to indicate the legal basis for its conclusion and cannot exceed five years.

A contract prolonged more than 3 consistent times is considered an employment contract for an indefinite period.

  • Moldova IT Park employment. IT park offers a simplified and flexible framework for companies operating in the IT sector. It provides a single tax regime – a flat
    7% of turnover – which replaces multiple other taxes, such as corporate income tax, personal income tax, social security, and medical contributions. This arrangement creates a favorable business environment, reducing administrative burdens and costs
    for employers.

Regarding employment, residents of the IT Park typically operate under special contractual frameworks. Companies can employ individuals as regular employees or on service contracts, depending on the specific needs and agreements. This flexibility allows
companies to structure their workforce efficiently while benefiting
from the simplified tax system.

A normal five-day working week is 40 hours.

Employees shall be granted the following types of leave:          

  • Annual paid leave

All employees have the right to an annual paid holiday, with a duration of not less than 28 calendar days without taking into account the non-working holidays.

  • Additional annual paid leave for some categories of employees.
  • Maternity leave

Prenatal holiday with a duration of 70 calendar days and postnatal holiday with a duration of 56 calendar days. 

  • Unpaid leave

Up to 120 calendar days on family circumstances and other valid reasons.

At least 14 calendar days due to some family status.

Long Stay Visa — Type D

Long stay visas are usually intended for those visiting the country for entrepreneurial activity, employment, study, family reunification, religious or humanitarian activities, diplomatic and service activities or medical treatment purposes.

  • Procedure for obtaining approval.

The requirements are the same as those for the airport transit visa and transit visa types A and B, but applicants may also need confirmation of admittance to a study programme (for an educational visa), travellers’ medical insurance for the Republic of Moldova, proof of means of payment for studies or any other proposed activities, an invitation from the Bureau for Migration and Asylum or, the resident’s permit or valid Visa issued by one member state of the European Union or of States Parties to the Schengen Agreement (except Transit Visa), and must pay a consular fee (around 40 EUR) that varies depending on the purpose of the visa. 

Time frame. Around 10-20 days

Foreign citizens who plan to stay in Moldova for more than 90
days have to obtain from the Bureau for Migration and Asylum of
Ministry of Internal Affairs.

  • Procedure for obtaining approval.

The foreign citizen or stateless person shall submit to the Bureau for
Migration and Asylum of Ministry of Internal Affairs, the following
documents:
– the medical certificate on state of health and medical test results for HIV / AIDS, in original,
– the copy of the national and international passports and passport Annex containing the visa with valid term,
– the argued opinion of the National Agency for Employment (for those who come to work) – AVIZ, requested by employer
– a copy of the employment contract for immigrants who come to work,
– Background check – criminal record (mandatory per local law) notarized and translated
– Lease agreement original,
– a copy of the study document (diploma/certificate),
– 3 photos, 5×6 mm,
– the receipt confirming the payment of the state fee.

Subsequently obtaining the certificate of immigration, the foreign citizen or stateless person shall conclude his/her residence permit at the Ministry of Information Development.

The residence permit is issued under the following documents:
– the medical certificate on the state of health and results of HIV /
AIDS antibodies test (the original),
– the copy of the passport and passport Annex + stamp of recording
to the DVP of the Ministry of Internal Affairs and visa with valid term,
– a copy of the marriage (divorce) certificates,
– the ID of the spouse, a copy,
– the argued opinion of the Employment Office,
– a copy of the employment contract,
– written consent of the person granting the housing, signed
notarized,
– a copy of the study document, specialty,
– 3 photos 5×6,
– the receipt confirming the payment of the state fee.

  • Time frame. Around 2-3 months.

Immigration matters in Moldova are under the remit of the Ministry of Foreign Affairs and European Integration of the Republic of Moldova (http://www.mfa.gov.md).

Citizens of other states who want to emigrate to Moldova have certain rights and are obligated to follow specific immigration rules. There are many countries whose citizens are required to get a visa or permit to stay in Moldova. These countries are outside the European Union and there are specific reasons why their citizens have to seek permission to be in the Republic of Moldova.

Citizens of other countries who hold a job offer or want to take up employment in the Republic of Moldova must get a work permit from the National Agency for Employment at the Ministry of Economy. Applicants must submit all the required documents to the National Agency for Employment.

The right of temporary residency can be granted for up to 5 years. In case of being granted for one year, there is a possibility of annual renewal.

The grounds for termination of the employment contract are:

– Termination by an employee.
The employee has the right to resign -to terminate the individual Labor contract on his own initiative, having informed the employer in a written application, 14 calendar days before that.
– Termination by an employer.
Such termination is allowed as per solid grounds described by the Labor Code.
Dismissal of the worker is not admitted during his sick leave, annual paid holiday, educational holiday, holiday for taking care of a child, and also during the period of detachment, except for the case of enterprise liquidation.

– Cancellation during the trial period
In the case of unsatisfactory results of the probation period, the dismissal of the worker is made by the employer before the expiration of the given probation term, without the severance pay. The worker has the right to appeal the dismissal in the judicial instance.

– Fixed-term contract expires.
Except for cases, when Labor relations actually proceed and none of the parties has demanded their discontinuance.

– Nullity of the individual Labor contract

– Special cases: not dependent on the will of the parties.

According to the Labor Code (186), the severance payment may not be higher than six monthly average salaries or lower than an average monthly salary for employees who have worked for at least one year with the employer.

Additional payments (for unused vacation days) are due at termination.

Severance is paid on the last working day with last salary.

In case of company liquidation or downsizing, reduction of employee’s staff, employees are entitled to:
a) Payment of severance pay for the first month – mandatory
b) Payment of severance pay for the second month in the amount of
the average monthly salary, if the dismissed person has not been re
-employed;
c) Payment of severance pay for the third month in the amount of th
e average monthly salary, if the dismissed person has not been reemployed;
d)It may be proposed to pay the severance for all three months in a
single lump sum to avoid issuing invoices on a monthly basis.

Two weeks’ average salary is paid as severance when an employment contract ends due to:
*Medical unsuitability or lack of qualifications (confirmed officially),
*Reinstatement of a previous employee by court decision,
*Employee refusal to relocate due to company move
