Malta has been a member state of the Commonwealth of Nations and the United Nations since independence, and joined the European Union in 2004; it became part of the eurozone monetary union in 2008. Malta is closely tied historically and culturally to Italy and specifically Sicily.

Currently, Malta’s major resources are limestone, a favorable geographic location, and a productive labor force.

Malta has a financial regulator, the Malta Financial Services Authority (MFSA), with a strong business development mindset, and the country has been successful in attracting gaming businesses, aircraft and ship registration, credit-card issuing banking licences and also fund administration

  • Employment contract

There are the following employment contract options:

  • Employment contract for an indefinite period
  • Employment contract for a definite period where an employee has been retained in employment after the date of termination of a contract of service for a specified time or has been re-employed by the employer for a fixed or indefinite term within one year from the date of termination of a contract of service for a specified time, the conditions of employment shall not be less favorable than those which would have been applicable had the contract of service been for an indefinite time and the aggregate probationary period shall in no case be longer than six months.

A normal five-day working week is 40 hours.
Employees in Malta are entitled to:

  • 24 days of paid vacation leave employees receive an extra day of annual leave for each such holiday.
  • 2 weeks of paid sick leave,
  • Female employees in Malta are entitled to 14 weeks of paid maternity leave, with a minimum of six weeks made available
    after they give birth.
  • Male employees expecting a child are also entitled to 10 days of paternity leave. The start of paternity leave should be within
    the first 16 weeks after childbirth.

The suspension of one or more employees constitutes legitimate grounds for declaring a trade dispute. Any such suspension must be instigated by a “good and sufficient cause”. Workers’ earnings are protected by law; so any deduction affected wages in the eventuality of a suspension is a fine imposed on the gross wage packet.

socialized healthcare system, but some employers may

still choose to offer private insurance in some cases.

An employer may terminate an employment contract upon:

  • Good and sufficient cause being shown;
  • Redundancy; or
  • When the retirement age is reached. 

Employees in Malta are generally entitled to notice periods prior to termination. The required minimum notice period varies based on the employee’s length of service, ranging from one week to eight weeks of notice.

Employees wishing to terminate a contract are not required to provide a reason for such termination as long as the employee provides the employer with a notice period in terms of law. Where the statutory notice of termination is not provided, the employee would be liable to pay the employer a sum equal to ½ of the wages that would have accrued during the notice period.

A dismissal shall be for reason of redundancy if it is wholly or mainly attributable to the fact that the employer has ceased, or intends to cease, to carry on that business for the purposes for which the employee was employed. This type of dismissal should still be applied as a measure of last resort, and the employer should be able to prove that it did everything in its power to avoid this outcome.

There is no legal severance pay or redundancy compensation other than the compensation in lieu of notice relating to redundancies.

Severance pay is required if an employer wishes to end a fixed-term contract before the expiry date and typically requires payment of the equivalent of half the expected wages for the remainder of the contract period.

For Malta’s accession to the EU, citizens of EU/EFTA countries and their close family members including spouses and children will not require any employment licenses for working in Malta, even if they are not EU or EFTA citizens. All other nationals, termed Third Country Nationals (TCNs), are to provide a single permit application for working and residing in Malta.

From 2014, every TCN is required to complete the process of a single permit. This is to be approved for work and residing in Malta. This single permit system requires the application of a Single Permit, which must include the following.

  • A valid employment contract copy,
  • Cover from private medical insurance for 12 months,
  • Position description signed by the employer,
  • A signed CV,
  • References for work experience of a minimum of three years to be submitted to Identity Malta.
